Terms of Use
IASME Supplier CheckThe User’s use of the Facility and Platform is subject to the following terms and conditions:-
Definitions
“Data Protection Law” means the UK General Data Protection Regulation; the Data Protection Act 2018; the Privacy and Electronic Communications Regulations 2003 (as amended) and all other UK data protection legislation (whether primary or secondary) and guidance issued from time to time by the Information Commissioner’s Office (ICO);
“Law” means Data Protection Law and all other laws of England and Wales relevant to the use of the Platform;
“Permitted Purpose” means for the purposes of determining whether or not the User’s listed suppliers have obtained certification under either Cyber Essentials or Cyber Essentials Plus (the Scheme). This is solely permitted for verifying the certification status of supply chains, and not for marketing the schemes to uncertified bodies, or bodies whose certification is near expiry.
“Platform” means the Scheme platform provided by IASME
User's Obligations
The User
- shall only use or cause or permit the Facility to be used for the Permitted Purpose;
- shall not upload or cause or permit to be uploaded to the Facility any third party confidential information;
- shall not use or cause or permit the Facility to be used for marketing purposes, including Market and Data Research;
- shall not be an existing Certification Body or Assured Service Provider for any of IASME’s schemes;
- shall not share or cause or permit to be shared the User’s unique log-in details;
- shall upload the minimum personal data necessary to meet the Permitted Purpose;
- shall ensure that all Suppliers whose details are uploaded are corporate entities (ie limited companies or limited liability partnerships) or registered charitable organisations;
- shall ensure that the organisation represented by the User is registered as a corporate entity or charitable organisation within the United Kingdom and its Crown Dependencies;
- shall not do or cause or permit to be done anything that might bring IASME or the Scheme into disrepute;
- shall comply with Law;
- shall not disclose the results of the search or searches made on the Facility to any other person or body save to the extent that it is compelled to do so by law or by order to a court or tribunal of competent jurisdiction;
- indemnify and keep indemnified IASME against all claims, damages, losses, expenses costs, civil fines and other liabilities resulting from or related to the breach by the User of any of the terms of this agreement;
- acknowledges that IASME gives no guarantee that the software will be free from bugs and errors, and may experience occasional outages.
Limited Warranty and Limitation of Liability
The User acknowledges and accepts that the Facility relies on third party data which may from time to time prove inaccurate and that there will be a delay between an application for certification being made and the details of that fact or any certification appearing in the Facility. For these reasons the Facility should not be relied upon to the exclusion of other checks and verifications that the User should make. In particular the User acknowledges and accepts that the User should require its suppliers to produce a valid copy of their CE or CE Plus certificate as the primary means of verification.
Whilst care has been taken to compile and maintain this Facility, IASME excludes, to the fullest extent permitted by law, liability for any loss or damage resulting from or in connection with the use of and reliance upon the Facility by the User.
Confidentiality
The User acknowledges and accepts that the fact that an organisation has applied for (but has not yet obtained) CE or CE Plus is confidential and accordingly disclosure of the fact that an application has been made must be kept confidential and must not be disclosed by the User to any third party.
